Married Gay Spouse To Be Deported

Bradford Wells and Anthony John Makk, a gay couple living in San Francisco , have been married for seven years and together for 19 years. Although they were legally married in Massachusetts in 2004, the marriage is not federally recognized because of the Defense of Marriage Act, which bans same-sex marriage.

 The Obama administration has ordered the deportation of Makk to his home country of Australia because his visa expired. Makk applied for permanent residency as a spouse of a U.S. citizen, but was denied because their same-sex marriage is not federally recognized.  

 Wells suffers from AIDS, and Makk is his primary caregiver.  While Wells could join Makk in Australia , he would no longer have medical insurance. Makk and Wells have said they’ll appeal the visa denial.
